1 Online Store Operator and Validity of These General Terms and Conditions

This online store is operated by Zermadi Moda (hereinafter referred to as ‘Zermadi Moda’).

These General Terms and Conditions apply to both the use of this website and online store, and specifically to the purchase of products sold in the store. By using the website, you agree to these terms and conditions.

Only these terms and conditions apply to product sales. Any different terms and conditions of customers are only valid if expressly approved by us.

Our products are sold exclusively to individual consumers in Switzerland and only in non-commercial quantities. Commercial sales, exports, or wholesale purchases are not included in this scope.

Zermadi Moda reserves the right to modify these terms and conditions at any time. The General Terms and Conditions in effect at the time of your order

shall apply.

2 Customer Account

You must enter your personal data accurately and completely during registration. You must keep your login details confidential and not share them with unauthorised third parties.

Each customer may only create one account. If multiple registrations are detected, these accounts may be deleted, and the relevant user may be warned or have their account closed.

3 Formation of the Contract

You can add products to your cart in the online store and complete your order by clicking the ‘Purchase’ button. You may modify your information until you click this button.

After placing your order, you will receive an automatic email confirming that your order has been received. This merely confirms that your order has been received by us; the sales contract has not yet been formed.

We reserve the right to accept your orders. In particular, orders with the payment method ‘invoice’ may be rejected if the credit check is negative.

We only consider your order accepted once we have shipped the products. The shipping notification is sent by email, and the sales contract only becomes valid with this notification.

The minimum order amount is 25 CHF. Orders below this amount will not be processed.

Our company reserves the right to remove you from the system without notice in the event of a breach of these terms and conditions.

4 Product Presentation, Availability and Delivery Time

Product information (features, colours, prices, stock status) displayed in the online store is generally binding. However, Zermadi Moda reserves the right to change its product range.

The appearance of a product in the online store does not necessarily mean it is always available. Delivery is only made from available stock.

If the ordered product is not in stock, your order may be cancelled in whole or in part. In such cases, we will notify you, and any advance payment will be refunded.

Products are typically delivered within 5-7 business days. If advance payment is selected, the process begins after payment is received. These timeframes are estimates and not binding.

Deliveries are made exclusively within Swiss borders.

5 Prices

All prices include applicable VAT. The prices at the time of ordering apply.

A shipping fee of CHF 5.50 is charged for each shipment.

The shipping fee for in-store pickup is CHF 4.50. Shipping is free for orders of CHF 75 or more.

6 Payment Terms

You can use the following payment methods:

Invoice payment (bank transfer within 14 days of receiving the product)

Credit card (Visa, MasterCard, American Express)

PayPal (you must create a PayPal account in advance)

Prepayment by bank transfer/EFT (bank details will be provided to you after placing the order)

Any costs incurred from agreements with credit institutions are your responsibility.

Payment methods may be restricted by our company in certain circumstances.

If payment is delayed when paying by invoice, legal late payment interest will apply. Additionally, a fee of 9.90 CHF may be charged for each reminder.

In cases of delay, non-payment, or credit card limit issues, access to the online store may be restricted.

You cannot offset your own claims against debts owed to our company.

7 Ownership Rights

Ownership of the products remains with Zermadi Moda until full payment is made.

8 Return Policy

You have a 28-day return period for purchases made through the online store.

You must send the return within 28 days of receiving the product. The product must be returned in its original condition, preferably in its original packaging, and must only have been used for testing purposes.

The return shipping cost will be covered by our company.

We will refund the cost of the returned products within 14 days, depending on the payment method you used. However, no payment will be made until the product reaches us or proof of shipment is provided.

The right of return does not apply in the following cases:

Food products, personal hygiene products, or products that cannot be returned for health reasons,

Products produced or personalised specifically at the customer's request,

Sealed products that cannot be returned for health or hygiene reasons and whose seal has been broken after delivery.
 

9 Warranty and Liability

We take the utmost care to ensure that our products are of high quality and comply with their descriptions. However, if the delivered product is defective, your legal warranty rights remain reserved.

We are only liable for damages arising from a breach of contractual obligations in cases of intent and gross negligence.

In the event of force majeure (e.g., natural disasters, war, strikes, government decisions, etc.) causing delivery delays or impossibility, ‘Zermadi Moda’ shall not be held liable for such delays.

Swiss law applies to these General Terms and Conditions and all contracts entered into with customers.

For non-consumer customers, the competent court is the city court where your company is located.

12 Final Provisions

If any provision of these terms is invalid, it shall not affect the validity of the remaining provisions.

The parties agree to apply a valid and economically similar provision in place of the invalid provision.

10 Privacy and Data Protection

The protection of your personal data is of great importance to us. Your personal data is processed and stored in accordance with the Privacy Policy text on our website. SSL encryption technology is used to ensure the security of order transactions.

11 Applicable Law and Competent Court

Swiss Federal Court
